Remove a Family Member or Friend From Your Home | Kowal LawMy grandmother passed away barely a month ago. She allowed a couple to stay with her for about 3 months, until her passing. We are having trouble getting them out. What do I do?

In most US states, Granny’s friends are now month-to-month tenants. That means the Executor of Granny’s estate will have to issue them notice that their tenancy is terminated and they have X days (whatever your jurisdiction requires) to vacate the premises.

If they fail to move out by that date, the Executor will have to move forward with an eviction and lockout.

OR, if there’s a mortgage on the property, the Executor should stop making the payments and let the bank foreclose on it or do a “deed in lieu” (Granny’s not going to care if her credit dinged now) Then the bank can deal with the tenants.
