My co-worker quit today, and now I’m being forced to work longer. My boss told me that the company cannot afford to pay me overtime, so I have to clock in and out when scheduled or I’ll be fired. Can I be fired if I refuse to work off the clock?

Actually, go-ahead and work all that overtime that he’s not going to pay. After about a week call the labor department and report him. They will do an investigation going all the way back to the time the company opened. Any overtime not paid to any employee will have to be paid back to those employees. They will also pay your overtime and ten percent finders fee. I had to go through that. Also good to know even if your paid bi-weekly overtime doesn’t start at 80 hours. It’s still a 40 hour week. One of my employers found that out as well.
